New Estate Agent Changes coming in November 2025

Several significant changes to Victoria’s estate agents regulations and related laws are set to take effect in November 2025:

Rental Market Reforms:

  • All types of rental bidding will be banned. [Source]
  • The notice period for rental increases or notices to vacate will be extended from 60 to 90 days. [Source]
  • No-fault evictions will be prohibited, preventing renters from being evicted without a valid reason. [Source]
  • A new standardized application form for renters will be introduced. [Source]
  • Charging fees for rental applications or rent payments will become an offense. [Source]
  • Annual smoke alarm safety checks will become mandatory for all rental properties. [Source]
  • Properties must meet minimum standards when advertised for rent, not just at the time of occupancy. [Source]

Real Estate Agent Regulations:

  • Real estate agents, property managers, owners corporation managers, and conveyancers will be required to register and undertake ongoing professional development. [Source]
  • Penalties for real estate agents and sellers who break the law will be increased to a maximum of $47,422, applying to offences such as underquoting and making false or misleading representations during property sales. [Source]

Consumer Protection:

  • The Director of Consumer Affairs and VCAT will have additional powers when considering rent increase reviews. [Source]
  • Real estate agents will be required to protect renters’ application information, adhering to privacy requirements. [Source]

Property Transactions:

  • From November 28, 2025, individuals will be limited to lodging only seven common land and property transactions without a lawyer or conveyancer.[Source]

These changes aim to improve transparency, protect consumers, and modernize the regulation of the real estate industry in Victoria. The reforms are part of the Consumer and Planning Legislation Amendment (Housing Statement Reform) Bill 2024, which has passed through the Victorian Parliament.
